Even when a city or county ordinance allows backyard chickens, a homeowners association (HOA) can prohibit them entirely. HOA rules are private agreements that homeowners agree to follow when purchasing property within a subdivision. These covenants often restrict livestock, agricultural activity, and certain exterior structures. As a result, even if municipal zoning permits hens, the HOA may still ban them.
Many buyers focus on public zoning laws and forget to review HOA bylaws until after closing. Unfortunately, by that point, they are legally bound by the subdivision’s covenants, conditions, and restrictions (CC&Rs). HOA documents frequently include language that prohibits “livestock,” “farm animals,” or “poultry,” which typically includes chickens. Violations can result in warning letters, fines, or even legal action if compliance is not achieved.
HOAs may also regulate related items such as fencing, accessory buildings, and yard appearance. Even if chickens are not specifically mentioned, rules governing outbuildings or visible structures could prevent building a coop or enclosed run. Some associations also enforce nuisance clauses that address noise or odor, which could be applied to chicken ownership even if poultry is not explicitly banned.
Before making an offer on a property within an HOA, buyers should carefully review all governing documents. Requesting CC&Rs during due diligence and reading them thoroughly helps avoid future conflicts and unexpected violations. Taking this proactive step ensures the home truly aligns with lifestyle goals and prevents costly disputes after closing.
